The US State-Level Legislation Opt-Out Banner Format toggle changes how Osano displays cookie banners across the United States. When enabled, it overrides Osano’s default explicit opt-in behavior, currently present in a subset of states, and applies an implicit opt-out banner for users in all 50 U.S. states.
Osano uses IP geolocation to automatically deliver the appropriate banner format to each site visitor, based on their location.
Default Behavior: Opt-In Banner
By default, Osano serves an explicit opt-in banner to users in states with active privacy laws, including:
California, Colorado, Connecticut, Delaware, Iowa, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Tennessee, Texas, Utah, & Virginia

This banner requires users to actively opt in to any cookie or script categories outside of “Essential.” It ensures compliance across different state regulations by not setting non-essential cookies until the user has given consent.
Optional: Opt-Out Banner Format
Enabling the US State-Level Legislation Opt-Out Banner Format setting modifies the default behavior for users in the above-listed states. When toggled on, users in all US states will instead see an implicit opt-out banner:

This banner does not require explicit consent and provides visitors with an automatic opt-in to all cookie/script categories. Users can change these settings at any time by accessing the Storage Preferences drawer widget.
Before enabling this setting, consult with your legal team to ensure it aligns with your organization’s privacy compliance requirements. Enabling this setting results in a banner that automatically opts users into tracking by default, rather than requesting their explicit consent. This format may reduce friction for end users, but could carry greater compliance risk depending on your interpretation of state privacy laws. If you want a more conservative, risk-averse setup, leave this setting OFF.
How to Enable the Opt-Out Banner Format
To turn on the US State-Level Legislation Opt-Out Banner Format:
- Log in to my.osano.com as an Administrator or Consent Manager.
- Navigate to the Cookie Consent section.
- Select the configuration you want to update.
- Click on Advanced Settings.
- Toggle US State-Level Legislation Opt-Out Banner Format ON.
- Click Save, then Publish your configuration.
- View the change immediately on your site, using an incognito browser to avoid cache interference.
